1. Acceptance of Terms

Welcome to Forge! By accessing or using the Forge mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Forge Fundamentals. We may update these Terms from time to time to reflect changes to our Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

2. Beta / Early Access Service

Forge is currently being made available to a limited number of users through invite codes for testing and feedback purposes. During this early access period, the Service is provided free of charge and certain features may change, break, or be discontinued without notice.

We may introduce additional features, including paid or subscription features, in the future. Your current access does not guarantee continued free access.

3. Eligibility

You must be at least 13 years old to use Forge. By using the Service, you represent and warrant that you meet this age requirement.

If you are between 13 and 17 years old, you must have your parent or legal guardian's permission to use the Service. By using Forge, you confirm that you have obtained such permission.

4. Description of Service

Forge is an IT fundamentals learning platform that provides:

  • Daily practice sessions with adaptive multiple-choice questions
  • Customizable quizzes across four core domains: Networking, Cloud, Security, and Systems
  • Topic-based quizzes with 40 topics across all domains
  • Real-time progress tracking with XP, levels, streaks, and prestige system
  • Leaderboards (Weekly XP, All-Time XP, Streaks, Domain-specific rankings)
  • Domain mastery analytics and detailed performance insights
  • Explanations and context for each question
  • Gamification features including prestige badges, weekly challenges, and XP multipliers

The Service uses adaptive algorithms to select questions based on your performance and knowledge gaps, helping you strengthen weak areas while continuing to progress in strong areas.

Important: Forge is an educational tool for learning IT fundamentals. It is not a certification program and does not guarantee job placement or professional qualifications.

5. User Accounts

5.1 Account Creation

To use the Service, you must create an account with an invite code. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

5.2 Account Termination

We may suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

You may delete your account at any time through the app settings. Upon deletion, your personal information will be removed in accordance with our Privacy Policy. Your learning progress, attempts, and statistics will be permanently deleted.

6. User-Generated Content and Profile Data

6.1 Your Content

You may upload profile pictures, set preferences, choose a display name, and create learning data through your use of the Service. You retain all ownership rights to content you upload.

6.2 License Grant

By uploading content, you grant Forge a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for the purpose of providing the Service to you. This includes storing your profile picture, display name, learning preferences, and progress data. If you opt in to appear on public leaderboards, your display name and ranking statistics may be visible to other users.

6.3 Content Guidelines

You agree that any content you upload will NOT:

  • Contain inappropriate, offensive, or explicit material
  • Violate any person's privacy or publicity rights
  • Contain hateful or discriminatory content
  • Infringe on any third party's intellectual property rights
  • Contain malicious code or viruses

6.4 Content Removal

We may remove any content that violates these Terms or is otherwise objectionable, at our sole discretion and without notice.

You can delete your uploaded content at any time through the app. Deleted content will be permanently removed from our systems within a reasonable period (typically up to 30 days).

7. Educational Content and Questions

Our questions and explanations are designed to help you learn IT fundamentals. While we strive for accuracy, we do not guarantee that all content is error-free or up-to-date with the latest industry standards.

Important Disclaimers:

  • Educational content may contain errors or become outdated.
  • Questions should not be relied on as the sole basis for professional decisions.
  • We are not responsible for exam results or job application outcomes.
  • Always verify critical information with official sources.

If you discover an error in a question or explanation, please report it through the app. We review and update content regularly.

8. Leaderboards and Public Features

8.1 Leaderboard Privacy

Forge includes leaderboards that rank users by various metrics including Weekly XP, All-Time XP, Streaks, and Domain Accuracy. By default, your username is hidden on leaderboards (you appear as "User #XXXX"). You can choose to display your username publicly through the Privacy Settings.

8.2 Public Information

If you opt in to appear on leaderboards with your username visible, the following information may be displayed publicly:

  • Your display name/username
  • Your current level and prestige level
  • Your XP totals (weekly and lifetime)
  • Your current streak
  • Your domain accuracy percentages
  • Your rank position on various leaderboards

8.3 Opting Out

You can toggle your leaderboard visibility at any time in Settings → Privacy Settings. When you disable visibility, your username will be hidden immediately and you will appear anonymously on all leaderboards.

9. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Scrape, crawl, or automatically collect questions or data from the Service
  • Interfere with or disrupt the Service
  • Impersonate any person or entity
  • Upload malicious code or viruses
  • Share invite codes publicly or sell access to the Service
  • Use the Service to create competing products
  • Abuse the gamification system through artificial means (e.g., XP farming, fake accounts)
  • Manipulate leaderboard rankings through fraudulent activity

10. Intellectual Property

10.1 Our Content

All content on Forge, including but not limited to questions, explanations, software, graphics, logos, and data compilations, is owned by Forge Fundamentals or its licensors and is protected by intellectual property laws.

10.2 Reference Materials

Our questions reference official vendor documentation and industry standards. These references are provided for educational purposes only and do not constitute endorsement by the original sources.

10.3 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial, educational purposes.

11. Fees, Subscriptions, and App Store Terms

The Service is currently provided without charge during the early access period. We may, in the future, offer paid tiers, subscriptions, in-app purchases, or premium features. If we do, some or all billing and cancellations may be handled by the Apple App Store or Google Play Store, and their terms may apply (including auto-renewal and refund rules).

We will notify you in the app if a feature requires payment and will present the applicable pricing and terms before you are charged.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Questions and explanations are completely accurate or comprehensive
  • The adaptive algorithm will perfectly match your skill level
  • Defects will be corrected
  • The Service is free from viruses or harmful components
  • Your use of the Service will result in certification or employment

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGE LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

This includes, but is not limited to:

  • Loss of data, including learning progress and statistics
  • Failed certification attempts or job applications
  • Service interruptions or data loss
  • Unauthorized access to your account
  • Inaccurate questions or explanations
  • Decisions made based on information from the Service

If you are dissatisfied with the Service, your sole remedy is to stop using it.

14. Indemnification

You agree to indemnify and hold harmless Forge Fundamentals, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload to the Service

15. Copyright / DMCA

If you believe that content on the Service infringes your copyright, please notify our designated DMCA agent with a detailed notice. Once we receive a proper notice, we will respond in accordance with the Digital Millennium Copyright Act (DMCA).

DMCA Agent:

You must include: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) contact information, (4) a statement of good faith, and (5) your signature.

16. Dispute Resolution and Governing Law

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware and applicable federal law of the United States, without regard to its conflict of laws principles.

16.2 Binding Arbitration & Class Waiver

You and Forge Fundamentals agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service will be settled by binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable rules.

YOU AND FORGE LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@forgefundamentals.com and stating that you wish to opt out of arbitration.

17. Changes to Service

We may modify, suspend, or discontinue the Service (or any part of it) at any time without notice, especially during the early access period. We are not liable for any modification, suspension, or discontinuation.

18. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forge Fundamentals regarding the Service and supersede all prior or contemporaneous agreements.
